A 39-year-old Smyrna man was charged with felony DUI (fouth offense), resisting arrest and disorderly conduct after an early-morning incident in the Dove Run Blvd. area of Rt. 299 in Middletown.


A 39-year-old Smyrna man was charged with felony DUI (fouth offense), resisting arrest and disorderly conduct after an early-morning incident in the Dove Run Blvd. area of Rt. 299 in Middletown.

Middletown Police said Curtis D. Gosnell, of the first block of Markham Court, was found asleep in a vehicle with the engine running at 2:19 a.m. on Oct. 20. Officers checked on the welfare of the vehicle operator, who was reclined in the drivers seat.

Police said it took several minutes to rouse Gosnell. Police said that while talking to him, they determined that he had been drinking earlier in the evening, and he stated “my car broke.”

Officers said they attempted to have Gosnell perform a field sobriety test, which he refused to do. Gosnell was asked to exit the vehicle, but he refused to comply and had to be forcibly removed, police said.

A blood draw was conducted at Middletown Police headquarters, and results are pending. Gosnell eventually consented to a preliminary breath test, which police said showed positive for the consumption of alcoholic beverages.

Gosnell was arraigned through JP Court 11 and was unable to post $5,750 secured bond. He was commited to Young Correctional Facility.
